2. Service Description
Quick Therapy Notes is an AI-powered tool designed to assist licensed mental health professionals in generating therapy session documentation. The Service:
- Converts user-provided bullet points into structured therapy notes
- Offers SOAP and Simple note formats
- Processes information temporarily without permanent storage of Protected Health Information (PHI)
- Provides suggestions that require professional review and verification
Important: This Service is a documentation assistance tool and does not replace professional clinical judgment, diagnosis, or treatment decisions.
3. Professional Use Only
This Service is intended exclusively for:
- Licensed mental health professionals
- Students under appropriate supervision
- Healthcare providers authorized to create therapy documentation
By using this Service, you represent that you are a qualified mental health professional or authorized user.
4. HIPAA Compliance and Data Handling
4.1 HIPAA Compliance Design
Quick Therapy Notes is designed to support HIPAA compliance through:
- Encryption of data in transit
- No permanent storage of Protected Health Information (PHI)
- Secure processing through HIPAA-compliant third-party services
- Local storage of generated notes on user devices only
4.2 User Responsibilities
You acknowledge and agree that:
- You remain solely responsible for HIPAA compliance in your practice
- You must review and verify all AI-generated content before use
- You should not include unnecessary PHI in your input
- You are responsible for securing your device and account
4.3 Data Processing
When you use our Service:
- Your input is processed temporarily to generate notes
- Generated notes are delivered to your browser and stored locally
- No therapy content or PHI is permanently stored on our servers
- Processing occurs through Botpress, a HIPAA-compliant AI service
5. User Account and Subscription
5.1 Account Creation
To access premium features, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials.
5.2 Subscription Plans
- Free Demo: Limited to 7 notes per year, no account required
- Premium: Up to 65 notes per month with account required
5.3 Payment and Billing
Premium subscriptions are billed monthly or annually. All fees are non-refundable except as required by law. You may cancel your subscription at any time through your account settings.
6. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Share your account credentials with unauthorized persons
- Attempt to reverse engineer or compromise the Service
- Use the Service to generate false or misleading documentation
- Input excessive or unnecessary PHI
- Use the Service for non-therapeutic purposes
7. AI Tool Limitations and Disclaimers
7.1 AI Limitations
You acknowledge that:
- AI-generated content may contain errors or inaccuracies
- The Service provides suggestions, not definitive clinical documentation
- Professional review and verification of all output is required
- The Service cannot replace clinical judgment or expertise
7.2 Professional Responsibility
You remain fully responsible for:
- All clinical decisions and documentation
- Verifying accuracy of generated notes
- Compliance with professional standards and regulations
- Patient care and treatment decisions
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Quick Therapy Notes provides the Service "AS IS" without warranties
- We are not liable for any clinical decisions or patient outcomes
- Our liability is limited to the amount you paid for the Service
- We are not responsible for data loss or technical failures
9. Indemnification
You agree to indemnify and hold harmless Quick Therapy Notes from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your clinical practice or patient care decisions
- Any breach of professional obligations
10. Service Availability
We strive to maintain Service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service with reasonable notice.
11. Termination
Either party may terminate this agreement at any time. Upon termination:
- Your access to the Service will cease
- Any locally stored notes remain on your device
- No refunds will be provided for unused subscription time
12. Changes to Terms
We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of the United States and the state where Quick Therapy Notes is incorporated, without regard to conflict of law principles.
